- Object
1.1 These General Conditions, together with the order form and the other elements mentioned therein, are intended to regulate the terms and conditions governing the provision of the service of the Online Store of the Val Escudeiro brand, headquartered in Rua Principal, 420 Chaminé – 2205-209 Bemposta – Abrantes.
1.2 The purchase of any product on the Val Escudeiro Online Store implies acceptance of these General Online Sales Conditions.
- Product Information, Prices and Contents
2.1 Val Escudeiro reserves the right to modify, without prior notice and at any time, the information and commercial offer presented on: products, prices, promotions, commercial conditions and services.
2.2 The images that illustrate each product at Val Escudeiro may differ from the product subsequently delivered, and these same products are also subject to out of stock.
2.3 Despite Val Escudeiro's efforts, some products may have an inaccurate price, which is why the company checks prices whenever it processes orders. Consequently, the prices shown at Val Escudeiro are merely indicative and do not constitute a contractual proposal. If the actual price of the product is lower than the advertised price, Val Escudeiro will refund the difference. If the price is higher, Val Escudeiro will inform the customer of such situation by email and await their decision to accept the new price or cancel the order within 15 days from the date on which the email was sent. .
- Order and Payment
3.1 After confirming the order at Val Escudeiro, an email will be sent to the contact address registered in the same by the customer when formalizing it, with the delivery details.
Val Escudeiro suggests that all customers confirm their details. If the customer does not receive the order confirmation email, he is requested to contact Val Escudeiro through the contacts made available on the website, so that this notification is sent again to the customer's email address.
3.2 If any of the details placed by the customer in the order are wrong and/or the customer wishes to change any information, as long as the order has not yet been shipped, the customer is requested to contact the following contacts as soon as possible so that the change requested by the customer can be made internally. Changes to the details of orders already shipped will have to be analyzed by the Val Escudeiro team so that, together with the customer, a more appropriate solution can be found.
3.3 All orders at Val Escudeiro will only be processed after effective receipt of payment. The formalization of the order alone does not constitute a reservation of the products.
3.4 If an order cannot be satisfied in part or in full, the customer will be contacted by Val Escudeiro in order to find the most appropriate solution.
3.5 Orders may be canceled when expressly requested by the customer through effective contact with one of those available and the respective response by Val Escudeiro, before the orders are dispatched. After confirming the shipment of the order, the customer is asked to contact Val Escudeiro so that, together with him, the most appropriate solution can be found.
3.6 Through the Val Escudeiro Online Store, payments are accepted by credit card, Multibanco, IBAN or Reference Entity processed and sent to the customer.
3.7 Payments are received in euros, regardless of the currency in which the transaction is carried out, the conversion rates for payments made in other currencies will have to be borne by the customer.
- Shipping costs
4.1 To the prices shown on the products, the respective shipping costs are added to each order, which are calculated based on the sum of two factors: the weight of each pack and the cost of transport to a certain area or country. The cost of transport therefore depends on the weight of the order and the respective delivery destination. This shipping value can be simulated inside the shopping cart with the desired products added and filling in all the requested fields of the simulator. The total postage will also be automatically calculated when placing your order on the Online Store. It should be noted that the factors in this calculation may be variable and change without prior notice.
- Expeditions
5.1 For orders to be sent to the requested address, the option for the respective country must be chosen in the billing address field.
5.2 In general, after dispatch, an order will take approximately:
– 2 to 3 days in mainland Portugal;
– Between 4 to 8 days in the European Union.
5.3 After the shipment of orders, the information for monitoring the shipment will be sent via e-mail with the information on the link for monitoring. If for some reason the customer does not receive the shipment confirmation in the following days, he should contact Val Escudeiro through one of the contacts on the website.
5.4 After notification of dispatch, customers must follow the status of the shipment through the link provided by Val Escudeiro, so that they are aware of the status of evolution until the moment of delivery of the order, since Val Escudeiro does not notify each shipping status change.
5.5 All products sent by Val Escudeiro must be checked upon delivery. If the customer finds that the order is damaged, he must immediately return it to the transport company, duly justify the reason for the return on the carrier's delivery note and immediately notify Val Escudeiro through one of the available contacts.
5.6 If, after delivery, the customer finds that any of the items are not in compliance, he is requested to contact Val Escudeiro immediately via email comercial@valescudeiro.pt indicating the order number or the number of the document that accompanied the order, attaching images of the packaging as received and of all the items, so that the process of investigating the occurrence is opened internally and in this way the situation can be resolved as quickly as possible. brevity possible.
5.7 Customers are responsible for any seizure of their orders, as well as the payment of customs fees, if any. In case of returning products, Val Escudeiro will only refund the amount corresponding to these same products. In case of doubt, the customer can contact Val Escudeiro before ordering.
5.8 Val Escudeiro has contracted services with specialized carriers for deliveries in Portugal and Europe. Every effort is made to meet the shipping and delivery deadlines, however it should be noted that possible delays in deliveries may be of a nature unrelated to Val Escudeiro, and it is not possible, in these cases, to guarantee exact delivery times.
5.9 Most deliveries are made during office hours on working days at the shipping address indicated by the customer when submitting the order.
5.10 In the event of an unsuccessful delivery attempt by the transport company due to absence, a note of passage is always left in the customer's mailbox with the carrier's instructions. Depending on the service and the carrier, orders must be picked up at the location indicated by the same in the passage notice, or the indications requested in the same notice must be followed.
5.11 If for some reason the customer cannot receive the order or pick it up at the location indicated by the carrier, the customer is requested to contact Val Escudeiro so that together the most appropriate solution can be found.
- Applicable law
6.1 Val Escudeiro recognizes to all its customers the right to terminate the contracts they enter into with it, allowing them to return, within a period of 14 (fourteen) days, the products purchased under the terms of Decree-Law n.º 143/ 2001 and Decree-Law 82/2008 of 20/05.
6.2 For exchanges or returns, the customer is requested to contact Val Escudeiro via email, comercial@valescudeiro.pt indicating the number of the order or the document that accompanied it, taking into account the conditions described below in the following topics:
a) Exchanges or returns are not allowed after receipt of the ordered products, with rare exceptions.
b) The return of any defective products and mistaken shipments will be admitted, Val Escudeiro being responsible for the shipping and collection costs whenever the customer communicates this circumstance within a period of 3 (three) days from the date of receipt of product.
c) For the purposes of exchanges or returns, problems that may have arisen with the labels or image of the product in a possible transport of the products are not considered defects.- d) Once the goods are received at our facilities and after validation of the condition of the same, the value will be refunded according to the payment method made by the customer, or another solution previously agreed with the same , like the exchange.
6.3 Val Escudeiro will not accept the return of the product after it has been used, or if it has been altered or modified.
6.4 Val Escudeiro is not responsible for deficiencies resulting from incorrect use, negligence, bad storage conditions or causes of force majeure.
6.5 All purchases made on the Val Escudeiro website are subject to Portuguese law. Any conflict or divergence of interpretation of the General Online Sales Conditions will be submitted to the competent Portuguese Court.
6.6 If the Customer is located outside mainland Portugal, Val Escudeiro informs you right away that any legal proceedings must be exclusively initiated in the Portuguese Courts.
